Terms of Use

1. The Service

Olkano is a daily check-in safety application that lets you set up a daily "I'm OK" signal and designate trusted contacts who are notified if you miss a check-in. The Service is intended as a personal safety aid and convenience tool. It is not a substitute for emergency services. If you or someone you know is in immediate danger, contact your local emergency services (e.g. 112, 911).

2. Eligibility

You must be at least 16 years old to create an account and use the Service. By using Olkano, you represent that you meet this age requirement. If you are under 18, you confirm that a parent or legal guardian has reviewed and agrees to these Terms on your behalf.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and current information when creating your account and to update it as necessary. We reserve the right to suspend or terminate accounts that violate these Terms or that appear to be fraudulent or inactive.

4. Subscriptions and Payments

Olkano offers a free tier and a paid subscription ("Olkano Plus"). Olkano Plus is available as a monthly or annual auto-renewing subscription.

• Pricing is displayed in the app before purchase. Prices may vary by region and are subject to change with reasonable notice.
• Subscriptions are billed through the platform where you made the purchase (Apple App Store or Google Play Store). Payment processing is handled entirely by the respective platform; we do not collect or store your payment card details.
• Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
• To cancel, use the subscription management settings of your device (Apple: Settings > Apple ID > Subscriptions; Android: Google Play > Payments & subscriptions > Subscriptions). Cancellation takes effect at the end of the current billing period; you retain access to Plus features until then.
• Refund requests are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly.

5. Account Deletion

You may delete your Olkano account at any time from within the app. Deleting your account permanently removes your profile, check-in history, and trusted contact associations. Certain records (such as payment transaction logs or security logs) may be retained for a limited period where required by law or for legitimate safety and accounting purposes. Deleting your account does not automatically cancel any active subscription; you must cancel your subscription separately through your device settings as described in Section 4.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Impersonate any person or entity, or misrepresent your identity.
• Harass, threaten, or send unwanted communications to any person, including via the trusted contacts feature.
• Interfere with or disrupt the Service, its servers, or connected networks.
• Attempt to gain unauthorized access to the Service or to other accounts.
• Use automated means (bots, scrapers) to access or interact with the Service without our written permission.

7. Intellectual Property

All content, trademarks, logos, and software associated with Olkano are owned by or licensed to Outwit Code LLC. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent. These Terms do not grant you any rights in our intellectual property except the limited right to use the Service as described here.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that notifications to trusted contacts will always be delivered on time. Olkano is not a medical, emergency, or monitoring service and should not be relied upon as one.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Outwit Code LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Outwit Code LLC from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Privacy

Your privacy matters to us. Our Privacy Policy, available at https://www.olkano.com/privacy/, describes how we collect, use, and share your information. By using the Service, you agree to the practices described in the Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
